1. Booking

Bookings must be made in writing, via Email or by Fax. Training camps can also be booked online at www.olebike.com. The contract is regarded as concluded when you received the confirmation by Olebike. The notifying party is liable, in addition to the participant, for the fulfillment of the obligations of the persons registered by him.

2. Payment & booking confirmation

a) Training camps (basic and premium packages with guided tours)
After the reception of the written confirmation by Olebike, a 20% down-payment of the total amount has to be paid. The 80% rest amount has to be paid at latest 6 weeks before your stay. The Payment can be effected by bank transfer or by credit card via the webpage of Blau Marí (www.blaumaritravel.com). Vouchers for the Hotel and other Services will be sent after final payment.
b) Training camps and holidays without guiding
After receiving the written confirmation by Olebike a 20% down- payment of the total amount has to be paid. The 80% rest amount has to be paid at latest 4 weeks before your stay. The Payment can be effected by bank transfer or by credit card via the webpage of Blau Marí (www.blaumaritravel.com).
c) Bicycle renting
After your booking has be confirmed a down-payment of 20% of the total amount has to be paid. The 80% rest amount has to be paid at latest 4 weeks before your stay. No repayment for no- shows. Please check point 6 for our cancellation terms.

3. Contracts for groups

Should one declarant book for a whole group, he is liable for the fulfillment of the contract for any single person of the group.

4. Responsibility of the tour operator

We agree on our own behalf and on behalf of our suppliers to take all reasonable skill and care in arranging your Cycling Holiday and providing the services to you.

5. Your responsibilities

We want you to have an enjoyable and care-free holiday. Please remember that while you are participating in a group holiday, your actions will have an effect on the other members of the group. If we, our cycling guides or our suppliers, are of the opinion that your behavior is causing distress, annoyance or disturbance to other members of the group, or is putting them in danger in any, we reserve the right to end your Cycling Holiday and terminate your contract. Should such a situation arise, we are not liable to refund you for the remainder of your holiday, nor are we liable to pay you compensation or any costs that you incur as a result.

6. Cancelation by you / Changes to your booking

The traveler may cancel the tour at any time prior to the commencement of travel by issuing a written declaration. In any case of a cancellation on the part of the traveler, Olebike will be entitled to the following cancellation fees taking into account the costs saved and the travel services utilized by other customers.
a) Cancelation
– More than 60 days before departure: free of charge
– from 59 to 30 days before departure: 25%
– from 29 to 8 days before departure: 50%
– from 7 to 4 days before departure: 75%

– from 3 days before departure or no show: 100%
b) For changes to your booking (dates or accommodation)
– More than 60 days before departure: rebooking fee of 25€
c) Replacement participant: until the departure the traveler may require that instead of him a third party enter the rights and obligations of the travel contract. In this case, Olebike is entitled to charge a rebooking fee of 25€.

7. Cancelation by Olebike

Before the beginning of the journey Olebike may terminate the contract if the traveler has failed to make the payment(s) on time.

8. Cancellation due circumstances beyond our control

If the voyage is severely impaired, endangered or canceled as a result of unforeseeable force majeure (for example, war, civil or political unrest, terrorism, poor weather conditions), both Olebike and the traveler may withdraw from the contract.

9. Complaints

a) It is our aim to provide the best Cycling Holiday possible. However, if you are not satisfied please complain as soon as possible to Olebike or relevant supplier by phone, face to face or in writing and we will do everything reasonably possible to sort the problem out. Your right to claim compensation may be extinguished, if we are not notified during your stay and therefore we are not able to solve a problem which may occur. b) When you get back home, if you feel that you need to make a formal complaint, send us your complaint within 28 days of returning home. We would point out that failure to follow the above procedures during your Holiday, and/or failure to complain within 28 days of your return, may reduce or extinguish

any rights you have to claim compensation from us, or from any relevant supplier.

10.Your fitness, your responsibility

Our Cycling Holidays assume that you have the desired level of fitness and cycling proficiency that will enable you to participate in and enjoy the tour you have chosen.
You acknowledge that by the very nature of cycling holidays, they are more physically challenging and demanding and you will be subject to a higher risk of injury. You accept that you have booked the holiday after giving due consideration to these risks and you therefore accept the inherent and increased dangers and risks associated with the proposed holiday and the accompanying risk of injury, death or property damage or loss. We will ask you to complete an ‘Acknowledgement of Responsibility and Liability’ form prior to you commencing your Cycling Holiday.
Wearing a bicycle helmet is a must in Spain. Participants are responsible for compliance with the road traffic regulations, even when participating in guided tours. In particular, care must be taken to ensure a safety distance to the other cyclists and other road users and to take account of the road and traffic situation (road condition, traffic density). Olebike shall not be liable for damage to the participants caused by disregarding the dangers of cycling.

11. Exclusion of Liability

We will not be liable to you to the extent that any death or personal injury you may suffer is not due to any fault on our part or that of our servants, agents or suppliers because it is either attributable to you, or attributable to a third party who is unconnected to the Cycling Holiday and is unforeseeable or unavoidable; or because the failure is due to unusual or
unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised, or due to an event which neither we, nor our servants, agents or suppliers could have foreseen or forestalled.

12. Regular airport shuttle on Saturdays

In the particular case that our driver is not at the meeting point at the specific time, which can be the case due to traffic jam, the traveler should call by phone before leaving the meeting point. If the traveler lost the foreseen shuttle due to a delayed flight or delayed baggage pick-up, the traveler has no claim that the shuttle waits for the customer or reimburses the travel price. The shuttle has a fixed timetable. Together with the customer, we will search for the best alternative by phone.

13. Special services

Special services, which are not foreseen in the program and are booked by the travelers, can be arranged by Olebike. In this case the supplier is liable for the fulfillment of the contracted service.

14. Insurances

We recommend you to take out adequate travel (cancellation) insurance that is suitable for your needs prior to your cycling holiday.
It is important that your insurance covers you for cycling activities and any other related activities that you are likely to take part in during your Cycling Holiday. We would strongly advise that your insurance covers the cost of any medical emergencies that may arise and the cost of repatriation.

15.Ineffective

In the event that one of the aforementioned provisions is
ineffective or becomes ineffective in the future, the remaining provisions shall not be affected.

16. Data Protection

We reserve the right to use photographs, likenesses or images of participants secured or taken on any of our Cycling Holidays without remuneration in all media for bona fide promotional or marketing purposes if the customer has not explicit objected to the use.
